The procedure for obtaining a residence permit in Ukraine on the basis of employment

After obtaining a work permit, a foreigner should obtain a visa or leave Ukraine in order to change the purpose of entry.  The foreigner should do the following, depending on the country of  citizenship:

  • to leave Ukraine and apply to the Consulate of Ukraine for a work visa type D-04;
  • or change the purpose of entry into Ukraine from tourists to the working purpose of entry. This rule applies only to citizens of countries with a visa-free regime. Citizens of countries with a visa-free regime can stay in Ukraine for 90 calendar days within a 180-day period, so it is very important to monitor the number of valid days of stay in Ukraine. If the permitted amount of days for staying is exceeded, a foreigner is obliged to leave Ukraine and pay a fine at the border control. Then such a person will be able to return to Ukraine only when the 90 calendar days renew.

A foreigner needs to visit a migration service to apply for a residence permit not later than 15 working days before the expiration of visa or days of permitted stay in Ukraine.

A foreigner’s personal presence is required during the visit of the State Migration Service.  The migration officer takes photos of the foreigner/scans fingerprints / captures the electronic signature – these data are entered into the database of the migration service.

Required documents

  •   foreigner’s passport with a visa type D  or with a stamp about crossing the border.
  • translation into Ukrainian of the page of a foreigner’s passport document with personal data attested according to the legally established procedure;
  • a valid medical insurance policy for the entire duration of the residence permit;
  • a document confirming the payment of an administrative fee or a document, proving an exemption from such payment;
  • work permit;
  • the obligation of the employer to inform the State Migration Service of Ukraine and the State Employment Service of Ukraine about the termination of the employment contract (contract) with such a foreigner or such stateless person.

Term of residence permit review is 15 working days from the date of submitting the documents.

A residence permit is issued for the period of validity of a work permit-  from 6 to 36 months.
